Employees are entitled to have Union representation at the time of an interview that may lead to discipline. The Union representative helps protect the employee from intimidation. The representative also serves as an advocate and witness to what occurs at this meeting.
Management is not required to inform you of this right. It is up to you to assert your right to have Union representation.
Remember, if you are called into a meeting with management and you have reason to believe that you may be disciplined, read them you Weingarten rights!
“If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my Union representative, officer, or steward be present at the meeting. Without representation, I choose not to answer any questions.”
Once the Union representative has been called, they have the right to:
know the subject of the investigatory hearing
speak with you privately before the hearing
advise you on how to answer the question
speak during the interview
request that management clarify a question
Remember, this is not a grievance hearing. The Union representative cannot argue the case.
